CONTEST OVERVIEW: The “Beacon of Hope 2020 – Canada” contest (the “Contest”) is sponsored by Beacon Roofing Supply Canada Company (the “Sponsor”). The Contest begins on November 2, 2020, at 12:00 a.m. Eastern Time (“ET”) and ends January 6, 2020, at 11:59 p.m. ET (the “Contest Period”). The following is a summary of the stages of the Contest:
- • November 2, 2020 — December 7, 2020: Nominations of eligible persons
- • December 8, 2020 – December 13, 2020: Sponsor’s review of nominations and selection of five (5) Nominees to serve as Finalists in the Contest
- • December 14, 2020 – January 6, 2021: Publication of Finalists and opening of public voting for Finalists
- • On or before January 13, 2021: Identification and publication of contest winners
Subject to the terms and conditions outlined herein, Beacon will award one (1) Grand Prize and three (3) Second Prizes. For the winner of the Grand Prize, Beacon will arrange for a local roofing contractor of its choosing to work with the relevant Prize Winner to complete any necessary re-roofing work at the winner’s residence within a commercially reasonable period not to exceed six (6) months, with the materials for such work to be provided by IKO Industries Ltd. (“IKO”) and selected by the Contest Winner in his or her reasonable discretion among the roofing materials offered by IKO. For winners of one of the Second Prizes, Beacon will award a check for two thousand five hundred dollars ($2,500.00 CAD) to each winner.
ELIGIBILITY: Persons nominated to participate in the Contest must be (a) a legal resident of a province or territory of Canada other than Quebec (the residents of the Province of Quebec are not included in this contest); (b) at least eighteen (18) years of age or older at time of nomination; (c) qualify for Veteran status as defined by Veterans Affairs Canada; and (d) an owner and primary resident of the residential property for which the re-roofing work is to be provided (the “Nominees”). Nominees who are determined to be a prize winner (each, a “Prize Winner”) must have a unique, personal and valid social insurance number for Sponsor to report the tax liability associated with acceptance of the prize. Valid social insurance numbers will be determined by applicable regulatory requirements as further defined in the “Prize Claims” section of these official rules. Officers, directors, managers and employees (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Sponsor or IKO, and each of their respective parents subsidiaries, affiliates and related companies, licensees, distributors, retailers, dealers, printers, advertising and promotion agencies, consultants and agents, and any others engaged in the development, production, execution or distribution of this Contest are not eligible to participate or win a prize. Contest is subject to all applicable laws and regulations, and is void wherever restricted or prohibited by law. By participating in this Contest, you indicate your full and unconditional agreement to, and acceptance of, these official rules and the decisions of the Sponsor, which are binding in all respects. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: Anyone can nominate a Nominee for entry in the Contest, starting on November 2, 2020 at 12:00 a.m. ET through December 7, 2020 at 11:59 p.m. ET (the “Nomination Period”). Nominations to participate in the Contest must be submitted by going to the designated website established by Beacon for this Contest: https://go.becn.com/beaconofhopecanada (the “Website”) and following the on-screen instructions. To successfully nominate a Nominee, you must provide all information requested by Sponsor via the Website or otherwise and meet the conditions set forth in these Rules, including without limitation by providing (1) the full name, address, telephone and email (if applicable) contact information for the Nominee, as well as a photo of the Nominee that is suitable for publication; (2) at least three (3) photos of the residence in need of a new roof or roofing repairs; and (3) a brief explanation of why the Nominee is deserving of winning the Contest (500 words or less). By submitting such nomination, you represent and warrant to Sponsor that (a) you have obtained the express approval and permission from any person who may appear or be mentioned in any way in your entry, and (b) Sponsor’s use of your entry (including, without limitation, any photos) will not result in the infringement of any copyright, trademark, right of publicity, privacy or other legal right of any third party. By participating in this Contest, whether or not your Nominee becomes a Finalist you unconditionally agree to these Official Rules, Sponsor’s Terms of Use and the Privacy Policy located in the footer of the Website and www.becn.com. Failure to comply with the Official Rules, the Terms of Use, or Privacy Policy (as determined within the sole discretion of the Sponsor) may result in disqualification.
There is no limit on the number of nominations you may submit. Illegible or incomplete entries are void and will not be reviewed. Sponsor is not responsible for lost, late, or misdirected nominations not received or not processed regardless of cause. Materials submitted in connection with a nomination will not be returned to you.
WINNER SELECTION:
• Selection of Finalists. At the end of the Nomination Period, a committee of judges consisting of employees/representatives of Sponsor (the “Panel”) will evaluate all qualifying nominations using the following criteria, as weighted in the Panel’s sole discretion: (i) the Nominees’ veteran status and service record, (ii) the financial need of the Nominee, (iii) the nature and extent of the roofing repairs needed by the Nominee (the “Judging Criteria”), and (iv) the quality and content of the explanation accompanying the nomination. On or before December 13, 2020, the Panel will select five (5) Nominees as potential based on the Judging Criteria. All decisions of the Panel are final. Sponsor will reach out to each potential finalist, and upon each potential finalist’s verification of compliance with these Official Rules and consent to participate in the Contest, each potential finalist will become a finalist (each a “Finalist”). Sponsor will contact each potential Finalist after the Nomination Period has concluded, and each must consent to participate in the Contest by responding within three (3) days of Sponsor’s initial notification, and providing all information requested by Sponsor, including without limitation copies of any documentation Sponsor believes is necessary to verify the service record, property ownership/condition, or financial need of the Nominee, such as tax returns and income statements.
• Public Vote. Between December 14, 2020 at 12:00 a.m. ET and January 6, 2021 at 11:59 p.m. ET (“Voting Period”), visitors to the Website will be prompted to vote for their favorite Nominee from among the Finalists. During the Voting Period, the use of software or other automated processes to submit multiple votes, including engagement share pages or purchases, is prohibited and votes submitted by such means will be disqualified and disregarded. All results are unofficial until verified by Sponsor.
• Selection of Potential Winners. On or before January 13, 2021, Sponsor will select four (4) Finalists as the potential Grand Prize winners based on the results of the Public Vote, and will select a single Grand Prize Winner from among the Finalists. In the event of a tie for the fourth highest number of votes, the Nominee whose nomination was received first will be declared a potential Grand Prize winner. All decisions of Sponsor in declaring the potential Grand Prize winners are final.
Sponsor reserves the right to modify these Official Rules, including any of above dates (including but not limited to the Contest Period, the judging period, the Voting Period and the date of selection of the potential winner), if Sponsor (in its sole discretion) deems such modification necessary to ensure fairness and/or preserve the spirit or goals of the Contest
PRIZES: The Grand Prize winner will receive a prize consisting of a one-time residential re-roofing or other similar residential roof repair for the residence identified in their submission. Such work will be arranged by Beacon and performed by a local roofing contractor (veteran-friendly, if feasible) of Beacon’s choosing, will be completed using roofing materials and accessories manufactured by IKO and distributed by Beacon, and will be completed within a commercially reasonable period of the completion of the Contest, not to exceed six (6) months. Beacon will provide commercially reasonable assistance to the designated contractor and the Prize Winner to select the materials for such work in his or her reasonable discretion among the IKO roofing materials distributed by Beacon in his or her geographical market. The three (3) remaining Finalists determined by the Panel will each receive a check for two thousand five hundred dollars ($2,500.00 CAD), made payable to each winner. Prizes awarded to each winner are subject to the express requirement that the winner submit to Sponsor all documentation requested by Sponsor to permit compliance with all applicable tax reporting and withholding requirements.
Neither Sponsor nor its affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Contest or any prize beyond those warranties offered by the manufacturer or the designated contractor. Names of prize manufacturers/trademark owners are used solely for the purpose of identification of the prizes. No endorsement, authorization, sponsorship, or approval by prize manufacturers is intended or implied by such use. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor's sole discretion. Prizes are non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion. Taxes on prizes, if any and any other costs, fees or expenses not listed above are the sole responsibility of a Prize Winner. Winners will be responsible for all gratuities and other incidental costs or expenses not identified as being included in these rules. The depiction of the Prizes in any advertising or promotional materials may not reflect the actual prize delivered to the Prize Winners.
NOTIFICATION: After the conclusion of the Nomination Period, and the Panel’s determination of potential finalists, each potential finalist will be notified by available phone number or mail/email address, as determined solely by Sponsor, to verify their compliance with these Official Rules and consent to become Finalists. Except where prohibited, to claim any prize, or to become a Finalist, Sponsor may require the potential winner to complete, sign, and return an Affidavit of Eligibility/Liability Release/Publicity Release forms, appropriate tax documentation, and other applicable documents, postmarked within ten (10) days of the date on the notification. If a potential finalist or winner cannot be contacted or reached after three (3) attempts, is disqualified, or fails to timely execute and return any required forms, an alternate Finalist or Prize Winner will be selected from among the remaining non-winning eligible entries or Finalists based on the applicable criteria outlined above and will be notified as outlined above until the Prize Winners are confirmed. All prizes will be awarded. Under no circumstances will more than the advertised number of prizes be awarded.
PUBLICITY & MARKETING: BY ENTERING THE CONTEST, YOU AGREE THAT SPONSOR AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) HAVE THE ABSOLUTE RIGHT AND PERMISSION TO PUBLISH YOUR ENTRY ON THE WEBSITE AND TO BROADCAST, PUBLISH, OR OTHERWISE USE (IN ANY OTHER CHANNEL OR MEDIUM, INCLUDING SOCIAL MEDIA PLATFORMS) YOUR ENTRY, INCLUDING THE PHOTO, NAME, BIOGRAPHICAL AND OTHER INFORMATION PROVIDED AS PART OF YOUR ENTRY FOR ANY COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSE WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO YOU. BY ENTERING, YOU GRANT THE RELEASED PARTIES AN EXCLUSIVE, ROYALTY-FREE AND IRREVOCABLE LICENSE AND RIGHT (BUT NOT THE OBLIGATION) TO TELECAST, BROADCAST, COPY, EDIT, ADAPT, MODIFY, REPRODUCE, PUBLISH, CREATE DERIVATIVE WORKS OF, DISTRIBUTE, USE, OR OTHERWISE PUBLICLY DISPLAY ANY OR ALL OF YOUR ENTRIES, OR ANY PORTION THEREOF (INCLUDING ANY VIDEOS, PHOTOS OR OTHER CONTENT SUBMITTED OR PROVIDED TO SPONSOR), IN ANY MANNER OR MEDIUM THROUGHOUT THE WORLD IN PERPETUITY, FOR COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSES, AND TO LICENSE OTHERS TO DO SO, WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO YOU.
NO LIABILITY & INDEMNIFICATION: Sponsor and the Released Parties are not responsible for and entrants release each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, claim a prize, or otherwise participate in this Contest, or Sponsor’s ability to include all eligible entries, notify potential winners, or otherwise execute this Contest in the manner intended. Entrants further release and agree to indemnify Sponsor and the Released Parties from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property (including, without limitation, real property and personal property) which may be sustained in connection with this Contest including, but not limited to: (a) your participation in this Contest; (b) the receipt, ownership or use of any prize awarded; and (c) your breach of any of the terms in these Official Rules.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (if applicable); (b) unauthorized human intervention in any part of the entry process or the Contest; (c) electronic or human error which may occur in the administration of the Contest or the processing of entries; (d) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from participation in the Contest; (e) any printing or typographical, distribution or production errors in any Contest-related materials ; or (f) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries.
GENERAL CONDITIONS: Decisions of Sponsor and/or the Panel on all matters related to the Contest are final. Should any portion of the Contest be, in Sponsor’s sole discretion, compromised (as applicable) by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest and conduct the Contest in a manner which in its sole discretion is fair, appropriate and consistent with these official rules. Notice of such action by Sponsor will be made available. In such event, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these official rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
RIGHT TO DISQUALIFY: Sponsor reserves the right to disqualify or prohibit your participation in this Contest if fraud or tampering is suspected; if you fail to comply with any requirement of participation or with any provision in these Official Rules; if the nature of your behavior or communication at any point is disruptive, may or does cause damage or to any person, property, or to the reputation of Sponsor, or is otherwise not in accordance with all applicable laws and generally accepted social practices, all as determined in Sponsor’s sole discretion.
OFFICIAL RULES/WINNERS LIST: These official rules will be made available on the Website during the Contest Period, and the winners list will be posted to the Website on or before January 31, 2021.
